HR Alert – Family and Domestic Violence Leave
The Government has made changes to paid Family and Domestic Violence (FDV) Laws in Australia. As of 1 February 2023, the NES has been updated to reflect these changes.

When does this come into effect?
Medium to Large Businesses (15+ employees):
- 1 February 2023.
Small Businesses (less than 15 employees)
- 1 August 2023
What does this mean for you?
Family and Domestic Violence Leave:
- All employees are entitled to 10 days paid FDV leave at the employee’s full rate of pay.
- The annual entitlement resets at the employee’s work anniversary.
- There is also an administrative burden because of a prohibition on including any reference to FDV on an employee’s payslip.
- Employers are still obliged to keep records of the type of leave taken for accrual purposes.

- Managers and payroll staff understand the privacy obligation.
- Payslips must not mention FDV leave, including leave taken and balances.
